By using this site, placing an order, or applying to the Trade Program, you agree to these terms. If you do not agree, do not use the site.
All prices are in US dollars. Payment is due at the time of order. We accept major credit cards through Stripe and PayPal. We do not store your card number. We do store your order history, your shipping address, and the last four digits of the card you used.
We reserve the right to cancel orders that appear fraudulent, that violate our policies, or that we cannot fulfill. If we cancel your order, we refund your payment within 7 business days.
See the Shipping page for delivery windows, carriers, and international terms. Risk of loss passes to you when the carrier marks the package as delivered.
Unopened items in original packaging can be returned within 30 days for a full refund. Opened candles, used oils, and personalized items are not returnable. Damaged or defective items are replaced at our cost. Email atelier@thespiritualsurplus.com to start a return.
Trade Program applications are reviewed within 24 hours. Approval is at our discretion. Trade pricing is non-transferable. Trade accounts are for the business named on the application. Reselling to other retailers requires our written approval. White-label packaging is for your brand only; you may not repackage our items under a third party's brand.
All content on this site (text, photographs, product descriptions, the Spiritual Surplus name and logo) is owned by us or our licensors. You may not copy it, redistribute it, or use it to train machine learning models without our written permission.
Trade customers may use our product photography on their own retail site or social channels for the purpose of selling our items. This license ends when your Trade Program account ends.
The items we sell are intended for ritual, decorative, and craft purposes. We make no medical, health, or therapeutic claims. Crystal and herbal lore passed down through tradition is presented as cultural context, not as a substitute for medical care. If you have a medical condition, consult a qualified practitioner.
Our site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted or error-free.
To the maximum extent permitted by law, our total liability for any claim arising from your use of this site or your purchase of our products is limited to the amount you paid for the product or service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
You agree to indemnify and hold us harmless from claims arising out of your misuse of the site, your violation of these terms, or your violation of any third party's rights.
These terms are governed by the laws of the State of Michigan, without regard to conflict of laws principles. Any dispute arising from these terms will be resolved in the state or federal courts located in Michigan.
We may update these terms at any time. The effective date at the top will reflect the change. If you have an active Trade Program account, we will email you about material changes.
